It seems that Australia’s commercial networks are up to their old tricks, to sue and think later. PBL (Channel Nine) will go head to head with Ice TV, a EPG (Electronic Program Guide) provider. The court case which is to take place in October this year, will make a large change to the EPG system in Australia, depending on it’s outcome. In many other countries, commercial networks, work with EPG companies, but this is not the case in Australia.
“The core problem for TV stations is that an EPG allows users to eliminate TV commercials.”. It seems that the commercial networks have fallen behind the 8 Ball. They have no idea of where to go from here. So they best way to hold back things, is to stop anyone trying to get in front of them.
The funniest part of this case is that Ice TV have had 3 separate legal opinions that have said they aren’t breaching copyright. One of these opinions, coming from Gilbert & Tobin in 1999. This is the same firm, that will now represent Channel Nine at this case. Ice TV also invited Channel Nine, to review how their guide was created. Nine ignored this offer and decided just go to court.
